MEL GIBSON CLEARED OUT IN DRUNK DRIVING CASE

Getting quite the lucky break, on Tuesday after a judge ruled that his conviction stemming from his notorious 2006 drunken driving arrest was being expunged. The judge agreed to expunge his drunk-driving conviction considering his completion of his three-year probation.

The hollywood actor's lawyer, Blair Berk, asked a court to dismiss the drunk driving conviction since Gibson, 53, has successfully met the probation, which included alcohol education classes, AA meetings and paying fines.

Judge Lawrence J. Mira ruled that the actor was eligible to have the conviction expunged after completing the terms of his probation. He said, ''He does not appear to be on any sort of probation or facing any similar charges. So I will grant the petition and sign the order.'' He added, ''The charge is still valid for gun control purposes.''

''All this means is that Gibson's been staying out of trouble and it'll likely be approved by the court,'' said L.A. criminal defense attorney Anthony Salerno, who's not involved with the case.

''An arrest like this never fully disappears from one's record, but getting a dismissal helps in practical situations like crossing into Canada,'' Salerno added.

Mel Gibson was sentenced to three years of probation, paid about $1,600 in fines and had to attend Alcoholics Anonymous and other meetings. The actor successfully completed the terms of his three-year probation.
